DESCRIPTION OF SERVICE

FireWatch Pro is a fire watch compliance management platform that connects property managers, contracting companies, contractors, and fire departments. The Service includes NFC-based checkpoint verification, automated alert systems, shift management, and compliance reporting for commercial properties requiring fire watch services.

ACCOUNTS AND REGISTRATION

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to provide accurate and complete information during registration and to update your information as needed.

USER ROLES AND RESPONSIBILITIES

SMS AND VOICE COMMUNICATIONS

FireWatch Pro uses SMS messages and automated voice calls to deliver critical fire watch alerts, including missed check-in notifications, shift reminders, and escalation communications.

By using the Service and providing your phone number, you expressly consent to receive these communications. These messages are operational in nature and directly related to fire safety compliance.

Message frequency varies based on active fire watch assignments and alert conditions. Message and data rates may apply.

IMPORTANT: Opting out of SMS alerts may affect your ability to receive critical fire watch notifications. If you are an active contractor, opting out of communications may result in escalation to your supervisor or company contacts.

COMPLIANCE AND RECORD KEEPING

All fire watch activities, including NFC tag scans, missed check-ins, communications, and escalation events, are recorded and retained for compliance purposes. These records cannot be altered or deleted by any user. Records may be shared with fire departments and regulatory authorities as required.

FireWatch Pro is a compliance management tool. It does not replace the professional judgment of fire watch personnel, fire department requirements, or local fire codes and regulations.

ACCEPTABLE USE

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to falsify check-in records or patrol data
• Interfere with or disrupt the Service
• Share your account credentials with unauthorized individuals
• Attempt to circumvent NFC or GPS verification systems

LIMITATION OF LIABILITY

FireWatch Pro is a compliance management and communication tool. We do not guarantee the prevention of fire, property damage, or personal injury.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIREWATCH PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

IMPORTANT SAFETY NOTICE

FireWatch Pro is NOT a fire alarm, smoke detector, or life safety device. The Service does not replace building fire alarm systems, smoke detectors, carbon monoxide detectors, fire sprinkler systems, or fire watch personnel. Users are responsible for maintaining all required fire safety equipment as mandated by local codes and regulations.

TERMINATION

We may suspend or terminate your account at any time for violation of these Terms. You may request account deletion by contacting support@firewatchpro.watch. Compliance records will be retained per our data retention policy regardless of account status.

CHANGES TO TERMS

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify users of material changes via email or in-app notification.

GOVERNING LAW

These Terms shall be governed by the laws of the State of Texas without regard to conflict of law provisions.
